TERMS OF SERVICE
The rules that keep Wingman useful, fair, and safe for diners, venue teams, and the wider wing community.
Effective August 29, 2026 · Version 2026-08-29
These Terms form an agreement between you and Wingmobile App for use of Wingman. By creating an account or using the service, you agree to these Terms and acknowledge the Privacy Policy. If you do not agree, do not use Wingman.
1. Eligibility and accounts
You must be at least 13. If you are under the age of legal majority where you live, a parent or guardian must permit your use. Give accurate information, protect your credentials, and notify us of suspected compromise. You are responsible for activity under your account. We may require password reset, suspend, or terminate accounts to protect users or enforce these Terms.
2. Wingman is a community service
Ratings, rankings, venue data, menus, hours, prices, and user statements may be incomplete or wrong. Confidence labels and ranking calculations are informational opinions, not guarantees of quality, safety, allergen handling, availability, or business performance. Confirm material details directly with a venue. Do not rely on Wingman for medical or emergency advice.
3. Your content
You keep ownership of content you create. You grant Wingman a worldwide, non-exclusive, royalty-free license to host, store, reproduce, adapt for formatting/accessibility, display, and distribute that content only to operate, improve, promote, secure, and provide the service. The license ends when content is deleted, except for technical backup delay, lawful retention, and content already shared independently by others. You represent that you have rights to what you post and that it does not violate law or another person’s rights.
4. Acceptable use
Follow the Community Guidelines. Do not post illegal, threatening, hateful, harassing, sexually exploitative, deceptive, infringing, dangerous, or privacy-invasive material; manipulate ratings; impersonate others; buy or sell reviews; scrape at scale; bypass access controls; introduce malware; probe systems without written authorization; or use Wingman to harm people or venues.
5. Venue owners and promotions
Claims may require verification and can be rejected or revoked. Owner responses must remain professional and may not disclose private customer information. Sponsored content is labeled and does not purchase organic rating rank. Pilot campaigns do not include guaranteed delivery, targeting, pacing, billing, results, or return on investment unless a separate written agreement says otherwise.
6. Moderation and enforcement
You may report check-in content and block accounts from their profiles. Blocking limits mutual social interactions and signed-in visibility but is not a substitute for reporting dangerous or unlawful content. We may review reports, remove or limit content, restrict features, preserve evidence, or suspend/terminate access when reasonably necessary. We are not obligated to publish every submission. Submit appeals or urgent safety concerns through the private contact form.
7. Third-party services
Wingman can use or link to Google, AWS, venues, maps, browser notification providers, and other third parties. Their products and terms are separate. Wingman is not responsible for third-party availability, conduct, content, or transactions.
8. Intellectual property
Wingman’s software, branding, visual design, and non-user content are owned by or licensed to the operator and protected by law. These Terms grant only a limited, revocable right to use the service for its intended purpose.
9. Disclaimers
To the maximum extent allowed by law, Wingman is provided “as is” and “as available.” We disclaim implied warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation. Nothing here excludes warranties that cannot lawfully be excluded.
10. Limitation of liability
To the maximum extent allowed by law, Wingman and its contributors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, lost profits/data, venue experiences, food reactions, or third-party conduct. Any aggregate liability will not exceed the greater of amounts you paid Wingman in the prior 12 months or US$100. These limits do not apply where prohibited or to liability that cannot lawfully be limited.
11. Ending use and deletion
You may stop using Wingman at any time and can request deletion through Account Deletion. Sections that logically survive—including ownership, lawful retention, disclaimers, limits, and disputes—continue after termination.
12. Governing law and disputes
California law governs these Terms without regard to conflict-of-law rules, except where consumer law in your location requires otherwise. Before filing a claim, contact us and allow 30 days for an informal resolution. Courts with lawful jurisdiction in California will handle disputes unless applicable law gives you another venue. These Terms do not impose mandatory arbitration or waive a class-action right.
13. Changes and contact
We may update these Terms for product, safety, legal, or operational reasons. Material updates will receive reasonable notice and may require renewed acceptance. Contact us through the private support form. Operator: Wingmobile App, California, United States. No public business address is designated at this time.
